A company named Point Providers has been making offers to landowner to purchase their cell tower leases. They appear to be a representative for an unknown investor who is actually buying the leases. Steel in the Air, Inc. is a consulting firm that assists landowners with evaluating lease buyout offers from various companies like Point Providers. We recently assisted a client who received an offer from Point Providers to purchase a cell tower lease that they owned. The offer was not actually an offer to purchase the lease, but an option to purchase. It defined some basic terms but left out a good deal of detail. In essence, it appears that Point Providers was not actually purchasing the lease in this case, but signing an option that they could then assign to another company. When our client requested information about who Point Providers was going to assign the option to, their agent suggested that it wasn't important. We don't understand this. Since the landowner is entering into a long term (50 years to perpetual) arrangement to sell the lease whereby a third party will be negotiating future extensions and terms, it is important to know your "partner".

Compared to other buyout company offers that the landowner may receive, the offers can appear to be attractive. However, we suspect that Point Providers' offers are only be made on multiple carrier towers where the value to the landowner is greater. Thus, it is crucial that the landowner understand the value of their own lease, not as compared to offers they have received but against offers they COULD receive.
